An Advocate Helping You Fight Serious Drug Charges

In drug cases, law enforcement is often overzealous in an attempt to make arrests and overcharge suspects. After being arrested, one of the best things you can do to protect your rights and your freedom is to contact an experienced criminal defense lawyer right away.

I'm attorney Charles Sheeley of Sheeley Law, P.C. As a former prosecutor for Cass County, I know the criminal justice system well and am ready to defend you against nearly any type of drug charge, including:

  • Drug possession (marijuana, methamphetamine, cocaine, mushrooms, etc.)
  • Drug distribution
  • Possession with intent to deliver
  • Drug trafficking
  • Possession of drug paraphernalia
  • Illegal possession of prescription drugs

Fighting Back Against Illegal Search And Seizure

The Constitution's Fourth Amendment protects all Americans from unreasonable search and seizure. The rules and guidelines vary significantly depending on what is being searched and when (your home, your vehicle during a traffic stop, your pockets during an encounter with police, etc.). In general, however, for police to conduct a legal search, they must typically have a court-issued warrant or probable cause to believe that a crime was committed.

It is sadly common for drug cases to include searches that are questionable, if not clearly illegal. In such cases, we may be able to challenge the validity of a police search and file a motion to suppress evidence. If a court rules that the evidence was obtained in violation of your Fourth Amendment rights, that evidence cannot be used against you at trial.

There May Be Alternatives To Traditional Prosecution

Drug use and abuse are closely tied to addiction, and lawmakers are finally realizing that this public health crisis cannot be solved through punishment and incarceration alone. In recent years, jurisdictions throughout North Dakota have started to rely on specialized drug courts, pre-trial diversion programs and sentences that include substance abuse treatment services.

As your attorney, I will fight to give you access to these prosecution alternatives if they will provide the most favorable and valuable outcome to your case.
