Fighting Back Against Illegal Search And Seizure

The Constitution’s Fourth Amendment protects all Americans from unreasonable search and seizure. The rules and guidelines vary significantly depending on what is being searched and when (your home, your vehicle during a traffic stop, your pockets during an encounter with police, etc.). In general, however, for police to conduct a legal search, they must typically have a court-issued warrant or probable cause to believe that a crime was committed.

It is sadly common for drug cases to include searches that are questionable, if not clearly illegal. In such cases, we may be able to challenge the validity of a police search and file a motion to suppress evidence. If a court rules that the evidence was obtained in violation of your Fourth Amendment rights, that evidence cannot be used against you at trial.
